These Terms of use are entered into by and between you and Drumsandkeys, INC (” Company”, “we” or “us”). The following “Terms and Conditions”, together with any documents they expressly incorporate by reference, govern your access to and use of Drumsandkeys.com, including any content, functionality, and services offered on or through Drumsandkeys.com (the “Website”), whether as a guest or a registered user.

Acceptance of Terms

Use of our website indicates that you have read, understood, and agree to these “Terms and Conditions”. This agreement applies to all types of visitors, users, and others who access the services. We reserve the right, at our sole discretion, to change, modify, add, or remove portions of these General Terms of Use at any time. We will indicate on this page when the Terms were updated the last time.

Payment Policy

Users agree to pay all charges for using this Service as set forth on the Drumsandkeys website. To process payments relating to Lessons, Drumsandkeys integrates with PayPal/Stripe which handles secure payments. By providing a credit card or any other payment information at any point, you agree to have full authority over such payment method and you authorize PayPal/Stripe to charge such credit card or payment method.


Payment schedule: Payments shall be made in advance for all lessons scheduled, and must be received no later than 1 day before the first scheduled lesson.


Late payment penalties: Students can enroll in lessons before payment is made but if we do not receive the scheduled payment within 1 day after its due date, the following may apply.

  • Scheduled lessons will be canceled due to restricted available time for other students. Payment secures an exclusive lesson time slot in our calendar each week and they will only take place once payment has cleared (availability of the previously reserved time not guaranteed).

  • A temporary hold will be placed under the student’s account, restricting students from accessing any content within the student’s portal until payment is received.

 

Administrative fee: New students must pay a non-refundable registration fee of $25.00. This fee will cover the entire learning program (Registration, Tools, Apps, and Supplies).

Cancellation Policy

Lessons must be canceled at least 24 hours prior to the start time and any payment will then be refunded or rescheduled to a make-up lesson slot. In the case of rescheduling or cancelling a Lesson, the rescheduling party must reschedule or cancel through Drumsandkeys Portal or by contacting us at 786-627-7048/online@drumsandkeys.com.

Missed lessons and refunds:

  • Lessons missed or canceled with less than 24 hours’ notice shall not be refunded or made up (technical issues are not a valid excuse for missing a lesson). In really unexpected cases, you may contact us and we may provide you with a lesson credit at our sole and absolute discretion. The provision of credits in one instance does not entitle you to credits in the future for similar instances, nor does it obligate us to provide credits in the future, under any circumstance. Please make every effort to read all lesson reminders and schedule other activities around your lesson time (courtesy Email and SMS reminders are sent prior to every lesson).

  • We do not provide refunds for technical failures, power outages, or unreliable internet connections beyond our control. If a Teacher is unable to provide a Lesson due to a Student’s (i) inadequate hardware or bandwidth or (ii) inappropriate conduct, Drumsandkeys generally will not provide a Refund to Student. And if a Student feels that a Teacher’s conduct renders the Lesson impossible, the Student should inform Drumsandkeys within twenty-four (24) hours. All such situations, and any discussions concerning Refunds stemming therefrom, will be handled on a case-by-case basis.

  • Drumsandkeys is not responsible or liable for any refunds for lessons that took place. However, we might offer new learners a satisfaction guarantee in which case the price for the first Lesson which did not meet the expectations of the learner can be redeemed on new lessons with a new teacher or, at our judgment, be refunded. This does not apply in any case where the Student has already taken at least one lesson, misses a Lesson, or is late to a Lesson.

Renewals: Unless you notify us at least 24 hours prior to the next lesson or billing period, your fees will automatically renew and you authorize us to collect the then-applicable fee for such services (including, any upgrade you may request, as well as any taxes) using any credit card or other payment mechanism we have on record for you. Cancellations will take effect at the end of the billing period in which you request account closure. We cannot refund fees from subscriptions that were not cancelled at least 24 hours prior to the billing date.

Termination: Drumsandkeys reserves the right to terminate your registered account or block access to the website and the services, for any reason or no reason whatsoever, with or without notice, at any time. If a student decides to terminate lessons, Drumsandkeys asks for two-weeks notice. If no such notice is given, an administration charge of $25.00 will be payable.
